Which data are we processing?

We process the data you have provided us with. Considering the kind of service that we are going to deliver, we can process data from the following categories:

Which is the purpose of such personal data processing?

Processing made owing to the implementation of contracts. We will process your data with the purpose of informing you about services and products procurement, as well as to perform and fulfil the commitment.

Hipoteken process its customers’ data with the purpose of providing financial advice to them in the acquisition of real state in Spain. This data processing is made based on your consent.

In this framework Hipoteken will process your data in the development of general commercial actions and to offer you products or services similar to those you may have hired or on which you requested information for.

How long do we keep your data?

Concerning the activities developed by Hipoteken, your data will be kept for the following terms:

In the section of financial advice, should you take part in any transaction, we will keep your information for tax purposes for four years, once such deal has ended, and during a term of five years for the purpose of any liabilities that may exist.

Should you have provided us with your data authorizing us to send advertising or commercial information, or when such information is transmitted by our client, your data will be kept and processed with that purpose until you exercise your right of cancellation, that will be offered to you every time.

Which are the legal grounds for the processing of your data?

The reasons that legitimize Hipoteken to the processing of your data are two:

– The completion of a property transaction contract or an agreement to find financial solutions.

– Obtainment of the subject’s consent for processing the information requests and commercial mailings.

Who will be the recipients of your data?

The data provided by you may only be shared in the following cases:

– When required by Law because of legal, fiscal, labor or other obligations.

– We will share your data with third parties, should that transfer of data be necessary for the completion of the services bought to us. For example, at your request, we will transfer your data to financial organizations or financial advisory firms, notary agencies or law firms involved in the real estate transactions for which our services were engaged.

How did we collect your data?

The data we have access to has been directly provided by the data subject or his/her legal representative. No further data from additional sources or companies is processed.

What your rights are when providing us with your data?

You may exercise the rights of access, correction, cancellation, purpose limitation and opposition by sending a written request to the email address legal@hipoteken.com or alternatively to our operations address – Gran Via Marques del Turia 69, bajo izq, 46005 Valencia, Spain.

Any person concerned has the right to obtain confirmation on whether or not we, at Hipoteken are processing personal data concerning them.

Data subjects have the right to access their data and have the personal information about them rectified (if inaccurate), amended, or deleted when, among other reasons, such data are no longer required for the purposes for which they were collected.

Data subjects may request application of the purpose limitation principle of the processing of data, in which case we will solely keep them to establish, exercise or defend a right in a legal claim.

Under certain circumstances and on compelling legitimate grounds relating to their particular situation, data subjects may object to the processing of their data. Hipoteken will stop processing such data unless compelling reasons or the litigation of claims otherwise require.
